 Brightwater are currently seeking to recruit a qualified Barrister or Solicitor on behalf of a State Body. Candidates will be 1-4 years PQE with some demonstrable relevant experience for the role, although some training will be given. Our client regulates healthcare professionals and the role involves handling a caseload of appeals and the progression of same. You will be responsible for progressing appeals arising from decisions of Registration Boards in relation to Recognition and Registration applications. The role reports to the Head of Fitness to practice, and you will have 2 other staff members reporting directly to you. Key Responsibilities • Managing the appeals process and appeal files • Presentation of the Appeal files to the Appeal Committee at hearing • Liaising with other business units in preparing for an Appeal • Liaising and instructing external legal advisors as required. • Ensure the Appeals process under the remit of the Appeals Committee is followed in a clear and transparent manner, as per the process in place. • Attend Registration Board meetings where required in relation to the Appeals function • Develop policy and procedures relating to the Appeals process • Ensure polices that are developed or updated are approved through internal process or through Council. • Ensure provision of training to the Appeals committee members to ensure high quality regulation. • Manage the provision of training to the Disciplinary Committees and develop a schedule of training • Working with other team members to facilitate the design and deliver appropriate training to the Disciplinary Committees, Council, Registration Boards, Chairpersons and members of the Executive in relation to their respective statutory functions under the Act. • Supporting the Head of Fitness to Practise and Legal Affairs in the management and ongoing development of the Appeals unit Team • Assisting the Head of Fitness to Practise & Legal Affairs in working with the Professional Practise Advisory Committee (PPAC) • Developing policies, procedures, guidance notes and manuals which are underpinned by the Health and Social Care Professionals Act 2005 (as amended), in conjunction with other members of the team. • Assisting the Head of Fitness to Practise and Legal Affairs to ensure that information and knowledge is properly managed and reviewed within the Team e.g. SOPs, quality management systems, data management including the preparation of statistical information, process improvements etc. • Liaising with external stakeholders as appropriate; attending departmental and organisation wide meetings, corporate briefings and events or any other meetings as required. Requirements • Qualified as a Solicitor or as a Barrister with 1-4 years pqe, preferably with advocacy, litigation or regulation experience. • Awareness of the understanding of the Health and Social Care Professionals Act 2005 • Knowledge of administrative and constitutional law and Judicial Review. • An understanding of the law relating to professional regulation in this and other jurisdictions and other relevant Irish legislation. • An understanding of EU legislation in particular SI 8 of 2017 and regulation. • The ability to demonstrate a thorough knowledge of the principles of natural justice. • Experience of instructing counsel and external lawyers; litigation experience. • The ability to provide guidance to the Council, Registration Boards and Committees in relation to their functions, duties and powers. .
